Personal Injury Claims

A personal injury claim is one arising out of an event or series of events which cause one or more people to suffer physical, emotional or psychological injury. It could be a motor accident and someone could suffer the injury in the car or be a pedestrian. It could be an injury received at work, a trip or fall in the workplace, a shop or even on the pavement. The circumstances can be as diverse as life itself and the only common feature is that someone is injured or killed as a consequence of an accident or event that was not their fault.

What exactly is a 'no win no fee' agreement? As you might have guessed it is an arrangement between a solicitor and client which provides that in the event that the claim fails the client does not have to pay his solicitor. It sounds too good to be true and the golden rule in life is that if it sounds too good to be true then it probably isn’t (true, that is).

Well in this case it is almost true. A ‘no win no fee’ agreement has to be backed by an Insurance Policy (for which you have to pay) to cover any costs that you may be ordered to pay to the other party. If you win then you do have to pay your solicitor the basic fee and an extra fee which is known as a success fee, out of the payment you recover.

There are other costs which you will incur, such as Court fees and a fee for a Medical Report, these costs are known as disbursements and the losing party should pay all or part of those costs. However, you may be liable to pay your solicitor for any costs that the losing party is not ordered to pay.
